1. ACCEPTANCE OF TERMS
By downloading, accessing, or using the Archaeological Site of Delphi Audio Guide ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and:

"Content" means all audio, images, text, and other materials provided through the App

- Share, sell, rent, lease, or distribute the tour content
- Upload or transmit viruses, malware, or malicious code
- Use the App in any way that violates UK laws or regulations
- Attempt to gain unauthorized access to any part of the App or related systems
- Use the App to harass, abuse, or harm others
4. PURCHASES AND PAYMENTS
4.1 Tour Purchase
- The tour is available for purchase through Apple's App Store
- All payments are processed by Apple Inc. in accordance with Apple's terms
- Prices are displayed in British Pounds (GBP) or your local currency
- Prices include UK VAT where applicable
- Payment is required to unlock the full tour content
- All prices are subject to change without notice
4.2 UK Consumer Rights
As a UK consumer, you have certain statutory rights under the Consumer Rights Act 2015:
- Digital content must be of satisfactory quality, fit for purpose, and as described
- If the App is faulty, you may be entitled to a repair, replacement, or refund
- These statutory rights are in addition to any rights provided by Apple
4.3 Refund Policy
- Refund requests are subject to Apple's App Store refund policy
- To request a refund, contact Apple Support directly through the App Store
- We may consider refunds for technical issues that prevent app functionality
- Refunds are provided at our discretion and in accordance with UK consumer law
- You have a 14-day cooling-off period under the Consumer Contracts Regulations 2013, though this right may be waived if you download and begin using the Content
4.4 Free Preview
- A preview of the tour may be available before purchase
- Preview content is limited and does not include the full tour experience
5. INTELLECTUAL PROPERTY RIGHTS
5.1 Ownership
All Content in the App, including but not limited to:
- Audio narrations and recordings
- Photographs and historical reconstruction images
- Text transcripts, descriptions, and translations
- Maps, diagrams, and visual materials
- App design, interface, and functionality
- Trade marks and branding
is owned by us or our licensors and is protected by UK and international copyright, trademark, database rights, and other intellectual property laws.
5.2 User License
Your purchase grants you a personal, non-exclusive, non-transferable right to access and use the tour content for private, non-commercial use only. You do not acquire ownership of any Content or intellectual property rights.

6. CONTENT ACCURACY AND DISCLAIMERS
6.1 Historical Information

- We make no warranties regarding the completeness or accuracy of historical information

- GPS coordinates and location data are provided for general guidance only
- Accuracy may vary based on device capabilities, signal strength, and environmental factors
- Always follow official site signage, maps, and guidance from site authorities
- We are not responsible for navigation errors or inaccuracies
7. USE AT THE ARCHAEOLOGICAL SITE
7.1 Your Responsibilities
- The App is a supplementary guide and does not replace official site information
- You must respect the archaeological site and follow all official rules and regulations
- Follow all safety guidelines and warnings posted at the site
- Respect other visitors and maintain appropriate volume levels when using audio
- Be aware of your surroundings and potential hazards
- The Delphi archaeological site is a UNESCO World Heritage Site; treat it with appropriate respect
7.2 Site Access
- The App does not grant access to the Delphi archaeological site
- Separate entrance tickets must be purchased independently from local authorities
- Site opening hours, access rules, and entrance fees are set by the Hellenic Ministry of Culture
- We are not affiliated with, endorsed by, or responsible for the official Delphi archaeological site management
- We are not liable for site closures, restricted access, or changes to visiting conditions
8. DISCLAIMERS AND LIMITATIONS OF LIABILITY
8.1 Service Provided "As Is"
To the fullest extent permitted by UK law, the App and Service are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
We disclaim all warranties including but not limited to:
- Warranties of merchantability or fitness for a particular purpose
- Warranties that the Service will be uninterrupted or error-free

8.2 Limitation of Liability
Nothing in these Terms shall exclude or limit our liability for:

- We are not liable for losses arising from reliance on Content accuracy
- Our total liability for any claim shall not exceed the amount you paid for the tour

9. USER CONDUCT AND ACCEPTABLE USE

11. TERMINATION
11.1 Termination by You
You may stop using the App at any time by deleting it from your device.
11.2 Termination by Us
We reserve the right to:
- Suspend or terminate your access for violation of these Terms
- Suspend or terminate your access for fraudulent activity or misuse
- Discontinue the App or Service at any time with reasonable notice
- Modify features, functionality, or availability
11.3 Effect of Termination
Upon termination:
- Your license to use the App immediately ceases
- You must cease all use of the App and delete it from your device
- Provisions regarding intellectual property, liability, and dispute resolution survive termination
12. THIRD-PARTY SERVICES AND LINKS
The App may integrate with or link to third-party services (e.g., Apple Maps, historical reference websites). Your use of such services is subject to their respective terms and conditions and privacy policies. We are not responsible for third-party content, services, or practices.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Apollo Explorer, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from:
- Your use or misuse of the App
- Your violation of these Terms
- Your violation of any third-party rights, including intellectual property rights
- Your violation of any UK laws or regulations
14. GOVERNING LAW AND JURISDICTION
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
14.2 Jurisdiction
The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter.
14.3 Consumer Rights
If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in your local courts, and the applicable consumer protection laws of your jurisdiction shall apply.
15. DISPUTE RESOLUTION
15.1 Informal Resolution

15.2 Alternative Dispute Resolution
If we cannot resolve a dispute informally, you may refer the matter to:
- The UK Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr
- A relevant consumer ombudsman or alternative dispute resolution scheme
15.3 Legal Proceedings
If informal resolution and ADR do not resolve the dispute, either party may commence legal proceedings in accordance with section 14.
16. FORCE MAJEURE
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, pandemics, strikes, or failures of third-party services.
17. SEVERABILITY
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.
18. WAIVER
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by our authorized representative.
19. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements, understandings, and communications, whether written or oral.
20. ASSIGNMENT
You may not assign or transfer these Terms or any rights granted hereunder without our prior written consent. We may assign these Terms to any affiliated entity or in connection with a merger, acquisition, or sale of assets.

BY DOWNLOADING, INSTALLING, OR USING THE ARCHAEOLOGICAL SITE OF DELPHI AUDIO GUIDE, YOU ACKNOWLEDGE THAT:
- You have read and understood these Terms and Conditions
- You agree to be legally bound by these Terms
- You are at least 18 years old or have parental/guardian consent
